AJIO LUXE TERMS AND CONDITIONS

The terms and conditions as set out herein (“Terms”) constitute an agreement between Reliance Retail Limited, having its registered office at 3rd Floor, Court House, Lokmanya Tilak Marg, Dhobi Talao, Mumbai – 400 002, Maharashtra, India (“we”, “us” or “our”), which operates the www.luxe.ajio.com and is available on the mobile application ‘AJIO’ (defined below) and a natural or legal person who accesses and/or uses AJIO Luxe in any manner (“you” or “your”) or uses any current or future service or functionality or offer made available on AJIO Luxe Platform (“Service(s)”), as updated from time to time.
By using the AJIO Luxe Platform, you expressly agree to be bound by the Terms. If you do not agree with any of the Terms, please do not use the AJIO Luxe Platform. If you have any questions about the terms, please contact at customercare@ajio.com. Please note that your access to the Services, other platforms or utilisation of Products (defined below), offers or promotions in relation to the Products as may be provided by us or our affiliates, may be governed by other terms and conditions, policies or guidelines (“Additional Terms”) along with these Terms. If these Terms are inconsistent with any Additional Terms, the Additional Terms will control to the extent of such inconsistency with respect to the applicable Service or utilisation of the Product. These Terms govern your use of the AJIO Luxe Platform and transaction or dealings thereon.
For the purposes of these Terms: (a) “AJIO Luxe Platform” means the www.luxe.ajio.com, which include its corresponding mobile application – ‘AJIO’/tablet/desktop or any other digital mode and/or operating system as provided by us, on which you may avail the Services and includes applications controlled and managed by us which interact with one or more such mobile applications/websites/ tablets and digital modes as provided by us; (b) “Products” shall mean diverse range of fashion, home and beauty products listed on the Platform from time to time and other products offered for sale to you on the AJIO Luxe Platform; and (c) We and you are hereinafter individually referred to as “Party” and collectively as “Parties”.
These Terms are divided into 2 (two) parts. Please carefully read all the parts to understand the conditions applicable in case of usage of the AJIO Luxe Platform and for purchase of Products thereof.
PART A – TERMS AND CONDITIONS FOR USAGE OF AJIO LUXE PLATFORM
- GENERAL
- The terms and conditions for usage of the AJIO Luxe Platform as set out herein (“Terms of Use”) specifically govern your access and use of the AJIO Luxe Platform, which provides a forum for you to inter alia enable you to discover, select and buy Products listed on AJIO Luxe Platform at the indicated price at any time, from the locations serviceable by us.
- Please note that we may from time to time change the Terms of Use that govern your use of the AJIO Luxe Platform. Every time you wish to use our AJIO Luxe Platform, please check these Terms of Use to ensure you understand the terms and conditions that apply at that time. Further, please note that we reserve the right to either change the format and the content of the AJIO Luxe Platform or suspend the operation of the AJIO Luxe Platform for support or maintenance work, in order to update the content or for any other reason, at any time.
- Any accessing, browsing, or otherwise using the AJIO Luxe Platform indicates your agreement to these Terms of Use, the privacy policy of AJIO Luxe Platform and any other policies or guidelines that may be applicable on the AJIO Luxe Platform at the time of your access and usage of the AJIO Luxe Platform and which may be updated from time to time (collectively, the “Agreement”).
- This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder as may be applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
- We authorise you to view and access the AJIO Luxe Platform solely for identifying Products, carrying out purchases of Products and processing returns and refunds, in accordance with Return and Refund Policy, therefore, grant you a limited, revocable permission to access and use the Services.
- By accepting this Agreement, you affirm that you are 18 (Eighteen) years of age or above and are fully competent to enter into this Agreement, and to abide by and comply with this Agreement. If a user is below 18 (Eighteen) years of age, it is assumed that he/she is using/browsing the AJIO Luxe Platform under the supervision of his/her parent or legal guardian and that such user’s parent or legal guardian has read and agrees to the terms of this Agreement, including terms of purchase of Products on behalf of the minor user. In the event we are made aware that a user is under the age of 18 and is using/browsing the AJIO Luxe Platform without the supervision of his/her parent or legal guardian, we reserve the right to deactivate such user’s account without further notice. Further, if you are using the Services on behalf of a company or organisation, you represent that you have authority to act on behalf of that entity, and that such entity accepts this Agreement.
- REGISTRATION OF YOUR ACCOUNT
- In order to purchase Products on the AJIO Luxe Platform and/or avail the Services, you will have to register on the AJIO Luxe Platform. Registration is a one-time process based on successful mobile OTP (One Time Password) verification and you will be eligible to further access and avail the Services after filling in the necessary forms and after providing the necessary details as may be required by us at the time of your registration. For placing an order, you should login to your account by completing the successful mobile OTP verification.
- You are solely authorized to operate the account created by you. Consequently, it is your responsibility to maintain the confidentiality of the log in credentials of your account on the AJIO Luxe Platform and for restricting access to your computer/mobile/other similar devices to prevent unauthorized access to your account. You shall remain solely liable for all the actions undertaken through your account.
- You will: (a) immediately inform us of any unauthorized use of the account or any other security breach; and (b) ensure that you log out of your account at the end of each session. We, our employees, agents, directors and officers will not be liable for any loss or direct or indirect damage arising from your failure to comply with these Terms of Use. You may be held liable for any losses incurred to us or any other user due to unauthorized use of their account by you. We reserve the right to refuse access to the AJIO Luxe Platform, terminate accounts, remove or edit content at any time without notice to you.
- COMMUNICATION AND UNSUBSCRIPTION
- By accepting the Terms of Use, you also accept to receive news, updates, offers/ campaign related SMS, to the mobile phone number provided by you. By accessing and using the AJIO Luxe Platform and/ or verifying your contact number with us, you explicitly consent to receive such communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings, even if your contact number is registered under the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.
- You can unsubscribe/ opt-out from receiving marketing/ promotional communications, newsletters and other notifications from us at any time by following the instructions set out in such communications.
- DISCLAIMER OF WARRANTIES, INACCURACIES OR ERRORS
- We will try to ensure that all information and recommendations, whether in relation to the Products, Services, offerings or otherwise (hereinafter “Information”) provided as part of this AJIO Luxe Platform is correct at the time of inclusion on the AJIO Luxe Platform. We do not guarantee the accuracy of the Information. We make no representations or warranties as to the completeness or accuracy of Information.
- You agree that Information is being supplied to you on the condition that you will make your own determination as to the suitability of such information for your purpose prior to use or in connection with the making of any decision. No Information on the AJIO Luxe Platform shall constitute an invitation to invest in us or any affiliates. Any use of this AJIO Luxe Platform or the Information is at your own risk. Neither we, our affiliates, nor their officers, employees or agents shall be liable for any loss, damage or expense arising out of any access to, use of, or reliance upon, this website, the Information, or any third-party website linked to this AJIO Luxe Platform. We are not responsible for the content of any third-party sites and do not make any representations regarding the content or accuracy of material on such sites. If you decide to access links of any third-party platforms, you are doing so entirely at your own risk and expense.
- As means to assist the users in identifying the Products of their choice, we provide visual representations on the AJIO Luxe Platform including graphics, illustrations, photographs, images, videos, charts, screenshots, infographics and other visual aids. While reasonable efforts are made to provide accurate visual representation, we disclaim any guarantee or warranty of exactness of such visual representation or description of the Product, with the actual Product ultimately delivered to users. The appearance of the Product when delivered may vary for various reasons.
- Nothing contained herein is to be construed as a recommendation to use any Product, process, equipment or formulation, in conflict with any patent, or otherwise and we make no representation or warranty, express or implied that, the use thereof will not infringe any patent, or otherwise.
- We do not covenant or provide any representations and warranties:
- in respect of quality, suitability, accuracy, reliability, performance, safety, merchantability, fitness for a particular purpose/consumption or the content (including Product or pricing information and/or specifications) on AJIO Luxe Platform;
- that the Services will be made available at all times; and
- that the operation of AJIO Luxe Platform, including the functions contained in any content, information and materials on AJIO Luxe Platform or any third-party sites or services linked to AJIO Luxe Platform will be uninterrupted, or that the defects will be rectified, or that AJIO Luxe Platform or the servers that make such content, information and materials available are free of viruses or other harmful components.
- THIS AJIO LUXE PLATFORM AND THE SERVICES ARE PROVIDED TO YOU ON AN “AS IS” AND “WHERE-IS” BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES. WE, FOR OURSELF AND ANY THIRD-PARTY PROVIDING MATERIALS, SERVICES, OR CONTENT TO THIS WEBSITE, MAKE NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF THIRD-PARTY RIGHTS, WITH RESPECT TO THE AJIO LUXE PLATFORM, THE INFORMATION OR ANY PRODUCTS OR SERVICES TO WHICH THE INFORMATION REFERS. WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING FROM OR CONNECTED WITH THE SITE, INCLUDING BUT NOT LIMITED TO, YOUR USE OF THIS SITE OR YOUR INABILITY TO USE THE SITE, EVEN IF WE HAVE PREVIOUSLY BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- Disclaimer -To the extent permitted by applicable law, We, our officers, agents, employees and directors, disclaim any liability against any loss, damage, expenses, liabilities, claim, injury caused due to the failure of performance, omission, defect of products, or deletion, interruption, error, delay, virus, communication, unauthorised access, theft, destruction, alteration or use of records on the AJIO Luxe Platform.
- AVAILIBILITY AND ACCESIBILITY OF AJIO LUXE PLATFORM
- We control and operate this AJIO Luxe Platform from India and makes no representation that the materials and the content available on the AJIO Luxe Platform are appropriate to be used or will be available for use in other locations outside India. If you use this AJIO Luxe Platform from outside India, you are entirely responsible for compliance with all applicable local laws. These Terms of Use do not constitute, nor may these Terms of Use be used for or in connection with any promotional activities or solicitation by anyone in any jurisdiction in which such promotional activities or solicitation are not authorized or to any person to whom it is unlawful to promote or solicit.
- We have several websites offering Products, Services, content and various other functionalities to specific regions worldwide. The Services offered in one region may differ from those in other regions due to availability, local or regional laws, shipment and other considerations. We do not make any warranty or representation that a user in one region may obtain the Services from our site in another region and we may cancel a user's order or redirect a user to the site for that user’s region if a user attempts to order Services offered on a site in another region.
- Information that we publish on the world wide web may contain references or cross references to our Products, programs and Services that are not announced or available in your country. Such references do not imply that we intend to announce such Products, programs or Services in your country. Consult our local business contact for information regarding the Products, programs and Services that may be available to you.
- We constantly monitor the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral vouchers fraudulently shall be liable for legal actions under law and we reserve the right to recover the cost of goods, collection charges and lawyer fees from persons using the AJIO Luxe Platform fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of the AJIO Luxe Platform and any other unlawful acts or omissions in breach of these terms and conditions. In the event of detection of any fraudulent or declined transaction, prior to initiation of legal actions, we reserve the right to immediately delete such account and dishonour all past and pending orders without any liability. For the purpose of this clause, we shall owe no liability for any refunds.
- THIRD PARTY INTERACTION AND LINKS TO THIRD PARTY SITES
- In your use of AJIO Luxe Platform, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of advertisers or members or sponsors of AJIO Luxe Platform or access any other third-party website linked to the AJIO Luxe Platform. Unless otherwise stated, any such correspondence, advertisement, purchase or promotion, including the delivery of and the payment for goods and/or services, and any other term, condition, warranty or representation associated with such correspondence, purchase or promotion, is solely between you and the applicable third party. You agree that we have no liability, obligation or responsibility for any such correspondence, purchase or promotion, access or usage of any third-party website and the contract under such instances remains between you and any such third party.
- COPYRIGHTS IN RELIANCE CONTENT
- The AJIO Luxe Platform contains material, including text, graphics and sound, which is protected by copyright and/or other intellectual property rights (“Reliance Content”). All copyright and other intellectual property rights in the Reliance Content are either owned by us or have been licensed to us by the owner(s) of those rights so that it can use the Reliance Content as part of AJIO Luxe Platform. We retain copyright on all Information, including text, graphics and sound and all trademarks displayed on the AJIO Luxe Platform are either owned by or licensed to us.
- You may use and display the Reliance Content on your personal computer only for your personal use subject to the grant of a limited, revocable, personal, non-exclusive and non-transferable license to you by us when you register on the AJIO Luxe Platform, only for identifying Products, carrying out purchases of Products and processing returns and refunds in accordance with our Return and Refund Policy and for using and printing copies of the information on the AJIO Luxe Platform for your personal use and store the files on your computer for personal use only and not for business purposes.
- You may not: (a) copy (whether by printing off onto paper, storing on disk, downloading or in any other way), distribute (including distributing copies), download, display, perform, reproduce, distribute, modify, edit, alter, enhance, broadcast or tamper within any way or otherwise use any Reliance Content contained in the AJIO Luxe Platform. These restrictions apply in relation to all or part of the Reliance Content available on the AJIO Luxe Platform; (b) copy and distribute the Information on any other server, or modify or re-use text or graphics on this system or another system; (c) reproduce any part of the AJIO Luxe Platform or sell or distribute the same for commercial gain nor shall it be modified or incorporated in any other work, publication or web site, whether in hard copy or electronic format, including postings to any other web site; (d) remove any copyright, trademark or other intellectual property notices contained in the original material from any material copied or printed off from AJIO Luxe Platform; or (e) link any other material to the AJIO Luxe Platform, without our express written consent.
- The license granted to you does not include a license for: (a) resale of Products or commercial use of the AJIO Luxe Platform or Reliance Content, (b) any collection and use of product listings, description, or prices, (c) any use of AJIO Luxe Platform, the Services and/or of Reliance Content other than as contemplated in these Terms of Use, (d) any downloading or copying of login credentials of user, (e) any use of data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) any parts of AJIO Luxe Platform, and (f) creating and/ or publishing your own database that features parts of the AJIO Luxe Platform.
- If you believe that your intellectual property rights have been used in a way that raises concerns of infringement, please write to us at customercare@ajio.com and let us know of your concerns.
- TRADEMARKS
All the trade names associated with us and all Products and logos denoted with TM are trademarks or registered trademarks of us or our affiliates. Our trademarks may not be used in connection with any product or service that is not our product or service.
- LICENSE AND USE OF YOUR CONTENT
- You grant to us a royalty-free, perpetual, irrevocable, non-exclusive right and license to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works from, display worldwide, or act on any material posted by you on the AJIO Luxe Platform without additional approval or consideration in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content, and you waive any claim over all feedback, comments, ideas or suggestions or any other content provided through or on the AJIO Luxe Platform. You agree to perform all further acts necessary to perfect any of the above rights granted by you to us, including the execution of deeds and documents, at its request.
- You agree that we do not routinely monitor your postings on AJIO Luxe Platform but reserves the right to do so. However, if we become aware of inappropriate use of the AJIO Luxe Platform or any of its Services, we will respond in any way that, in its sole discretion, we deem appropriate. You acknowledge that we will have the right to report to law enforcement authorities of any actions that may be considered illegal, as well as any information it receives of such illegal conduct. When requested, we will co-operate fully with law enforcement agencies in any investigation of alleged illegal activity on the internet.
- Submissions and unauthorised use of any materials contained on the AJIO Luxe Platform may violate copyright laws, trademark laws, the laws of privacy and publicity, certain communications statutes and regulations and other applicable laws and regulations. You alone are responsible for your actions or the actions of any person using your username and/or password. As such, you shall indemnify and hold us and our officers, directors, employees, affiliates, agents, licensors, and business partners harmless from and against any and all loss, costs, damages, liabilities, and expenses (including attorneys' fees) incurred in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party that your use of the AJIO Luxe Platform or the use of the AJIO Luxe Platform by any person using your user name and/or password (including without limitation your participation in the posting areas or your Submissions) violates any applicable law or regulation, or the rights of any third party.
- We reserve the right to terminate access to this AJIO Luxe Platform at any time and without notice. Further this limited license terminates automatically, without notice to you, if you breach any of these Terms of Use. Upon termination, you must immediately destroy any downloaded and printed materials. Any provision of the Terms of Use which imposes an obligation or creates a right that by its nature will be valid after termination or expiration of the Terms of Use shall survive the termination or expiration of the Terms of Use.
- USER WARRANTIES AND RESTRICTIONS
- You represent and warrant that: (a) your use of AJIO Luxe Platform and/or Services will not violate any applicable law or regulation; (b) all information that is submitted to us in connection with AJIO Luxe Platform and/or Services is true, accurate and lawful; (c) use of the content and material you supply does not breach any applicable Agreement and will not cause injury to any person or entity (including that the content or material is not defamatory). If at any time, the information provided by you is found to be false or inaccurate, we will have the right to reject registration, cancel all orders, and restrict you from using the Services and other affiliated services in the future without any prior intimation whatsoever. You agree to indemnify us and our affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties.
- You will use AJIO Luxe Platform for lawful purposes only and will not undertake any activity that is harmful to AJIO Luxe Platform or its content or otherwise not envisaged through the AJIO Luxe Platform. You have a limited license to access and use AJIO Luxe Platform, solely for the purpose of availing the Services, subject to these Terms of Use.
- You will not do any of the following:
- Delete or modify any content on AJIO Luxe Platform, such as any information regarding the Services, their performance, sales or pricing;
- Use any engine, software, tool, agent or other mechanism (such as spiders, robots, avatars, worms, time bombs etc.) to navigate or search AJIO Luxe Platform;
- Make false or malicious statements against the Services, AJIO Luxe Platform or us;
- Post, copy, submit, upload, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise disrupt or damage AJIO Luxe Platform and/or Services or any connected network, or otherwise interfere with any person or entity’s use or enjoyment of AJIO Luxe Platform and/or the Services;
- Introduce any trojans, viruses, any other malicious software, any bots or scrape AJIO Luxe Platform for any information;
- Probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us or otherwise tamper or attempt to tamper with our technological design and architecture;
- Hack into or introduce malicious software of any kind onto AJIO Luxe Platform;
- Gain unauthorized access to, or interfere with, or damage, or disrupt the server on which the details connected to the Services are stored, or any other server, computer, or database connected to the Services; or
- Engage in any form of antisocial, disruptive, or destructive acts, including “flaming,” “spamming,” “flooding,” “trolling,”, “phishing” and “griefing” as those terms are commonly understood and used on the internet.
- You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing on or through AJIO Luxe Platform, any information that:
- belongs to another person and to which you do not have any right;
- is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, hateful, relating to or encouraging money laundering or gambling, or otherwise harmful in any manner whatsoever;
- harms minors in any way;
- infringes any patent, trademark, copyright or other proprietary rights;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
- impersonates or defames another person; or
- contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
- INDEMNIFICATION AND LIMITATION OF LIABILITY
You agree to indemnify, defend and hold harmless us, our affiliates, officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all third- party claims, losses, liabilities, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of AJIO Luxe Platform or the Services, violation of these Terms of Use, or infringement of any of our or any third-party intellectual property or other rights. We will notify you promptly of any such claim, loss, liability, or demand, and in addition to the foregoing, you agree to provide us with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.
- APPLICABLE LAW AND JURISDICTION:
These Terms of Use are governed by and to be interpreted in accordance with laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these Terms of Use or any dispute arising in relation to the AJIO Luxe Platform whether in contract or tort or otherwise, to submit to the jurisdiction of the courts located at Mumbai, India for the resolution of all such disputes.

- FORCE MAJEURE
We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond our reasonable control.
- WAIVER
No provision in these Terms of Use will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by us. Any consent by us to, or waiver of your breach, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
- SEVERABILITY
If any provision of these Terms of Use is held by a court of competent jurisdiction to be unenforceable under applicable law, then such provision will be excluded from these Terms of Use and the remainder of these Terms of Use will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided however that, in such event, these Terms of Use will be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction.
- AMENDMENT
These Terms of Use are subject to amendments and modifications and may be updated from time to time, without any advance notice. You are requested to regularly review the Terms of Use as available on AJIO Luxe Platform. You relationship with the AJIO Luxe Platform will be governed by the most current version of these Terms of Use, as published on AJIO Luxe Platform.
- MISCELLANEOUS
- In addition to these Terms of Use, you will also ensure that you are in compliance with the terms and conditions of the third parties, such as bank offers terms and conditions, brand promotional offers, whose links, if any, are contained/embedded in the Services. You agree that we will not be liable for any transaction between itself and any such third parties.
- These Terms of Use supersede all previous oral and written terms and conditions (if any) communicated to you by us, for the use of AJIO Luxe Platform, and the rights and liabilities with respect to any Services to be provided by us shall be limited to the scope of these Terms of Use.

PART B – TERMS AND CONDITIONS OF SALE ON AJIO LUXE PLATFORM
The terms and conditions of sale as set out herein (“Terms of Sale”) constitute an agreement between us and you and govern the terms and conditions on which you purchase your Products from us on or through the AJIO Luxe Platform. By placing an order for any Product with us or making a purchase of Product, you expressly agree to be bound by these Terms of Sale.
These Terms of Sale are in addition to the Agreement. These Terms of Sale constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.
- OUR CONTRACT OF SALE
- Listing and display of a Product by us on AJIO Luxe Platform is our invitation to you to make an offer for purchase of such Product. Likewise, the placement of an order on AJIO Luxe Platform by you is your offer to buy the Product(s) from us.
- Once you have placed an order with us for purchase of a Product, you will receive an e-mail and/or mobile confirming receipt of your order and containing the details of your order (the “Order Confirmation”). The Order Confirmation is merely an acknowledgement that we have received your order and does not signify our acceptance of your offer.
- We only accept your offer and conclude the contract of sale for a Product ordered by you, when the Product is shipped or dispatched to you and an e-mail and/or registered mobile number confirmation is sent to you that the Product has been shipped or dispatched to you (the “Shipment Confirmation”). We reserve the right, at our sole discretion, to refuse or cancel any order for any reason whatsoever before sending Shipment Confirmation to you.
- If your order is dispatched in more than one package, you may receive separate Shipment Confirmations for each package, and each Shipment Confirmation and corresponding dispatch will conclude a separate contract of sale between you and us for the Product(s) specified in that Shipment Confirmation.

While we shall make every endeavour to share prompt reminders and notifications relating to the delivery of purchased Product(s) with you, we shall not be held liable for any failure to send such notifications or reminders to you.
- Your contract is with us and you confirm that the Product(s) ordered by you are purchased for your internal / personal purpose and not for re-sale or business purpose. Please note that we sell Products only in quantities which correspond to the usual requirements of an average household. This applies both to the number of Products ordered within a single order and the placing of several orders for the same Product where the individual orders comprise a quantity typical for a normal household.
- All orders placed on AJIO Luxe Platform are subject to the availability of such Product, our acceptance of your offer as per the above and your continued adherence to these Terms of Sale.
- You hereby authorise us to declare and provide declarations to any governmental authority on request on your behalf, including that the Products ordered by you are for personal, non-commercial use.

- PRODUCT PRICING
- All prices are listed in Indian Rupees. Price, as displayed, is inclusive of all applicable taxes.
- Products in your shopping cart of AJIO Luxe Platform will reflect the most recent price as displayed on the Product’s information webpage on AJIO Luxe Platform. Please note that this price may differ from the price shown for the Product when you first placed it in your shopping cart. Placing a Product in your shopping cart does not reserve the price shown at that time. It is also possible that a Product’s price may decrease between the time you place it in your shopping cart and the time you place the order. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery.
- LICENSES
You acknowledge that there may be licenses/permissions required under the applicable laws to use, purchase or otherwise possess certain Product(s). You will be solely responsible for obtaining such licenses/permissions and complying with the terms of such licenses/permissions.
- TAXES
You shall be responsible for payment of all fees/costs/charges associated with the purchase of Products from us and you agree to bear any and all applicable taxes.
- ELIGIBILITY
Only persons who can enter into legally binding contracts as per Indian Contract Act, 1872, i.e., persons who are 18 (Eighteen) years of age or older, are of sound mind, and are not disqualified from entering into contracts by any law, can use AJIO Luxe Platform and place an order with us. If you are a minor i.e., under the age of 18 (Eighteen) years, you may purchase the Product on AJIO Luxe Platform only with the involvement of a parent or guardian.
- LIMITATION OF LIABILITY
In no event, our aggregate liability, if any, that is proven and ordered by a court of competent jurisdiction pursuant to a claim by you or person acting on your behalf, shall extend beyond the money charged from you for purchases made pursuant to an order under which such liability has arisen and been established. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when a contract for the sale of Product by us to you was formed.
- AMENDMENTS
We reserve the right to make changes to our policies, and these Terms of Sale at any time. You will be subject to the policies and Terms of Sale in force at the time you order Product from us, unless any change to those policies or these Terms of Sale is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
- FORCE MAJEURE
We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond our reasonable control.
- WAIVER
No provision in these Terms of Sale will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by us. Our consent to, or waiver of your breach, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
- GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Sale, all transactions consummated between you and us, and our relationship with you is governed by the laws of India, without reference to any conflict of laws principles and with an exclusive jurisdiction to the courts of Mumbai.
- MISCELLANEOUS
- In addition to these Terms of Sale, you will also ensure that you are in compliance with the terms and conditions of the third parties, such as bank offers terms and conditions, brand promotional offers, whose links, if any, are contained/embedded in the Terms of Use.
- These Terms of Sale supersede all previous oral and written terms and conditions (if any) communicated to you by us, for the purchase of Product.
FEES AND PAYMENTS POLICY
Reliance Retail Limited, having its registered office at 3rd Floor, Court House, Lokmanya Tilak Marg, Dhobi Talao, Mumbai – 400 002, Maharashtra, India (“Reliance”, “we”, “us” or “our”) is managing and operating the website www.luxe.ajio.com and mobile application ‘AJIO’ (collectively referred to as the “AJIO Luxe Platform”), through which it inter alia facilitates the sale and purchase of diverse range of fashion, home and beauty products listed on the AJIO Luxe Platform from time to time and other products (“Products”) to the users of the AJIO Luxe Platform (“User” or “Users” or “you” or “your”).
WHAT IS THIS FEES AND PAYMENTS POLICY?
This Fees and Payments Policy (“FPP Policy”), together with the Terms of Use describes Reliance’s accepted payment methods, and Reliance’s policies and procedures in relation to acceptance of fees and payments towards the services offered through the AJIO Luxe Platform. Reliance’s primary object is to ensure that the AJIO Luxe Platforms are user friendly and equipped with reasonably expected security infrastructure to protect any financial information which may be shared by User.
User(s) are required to peruse and understand the terms of this FPP Policy. If you do not agree to the terms contained in this FPP Policy, you are advised not to accept the Terms of Use and this FPP Policy and may forthwith leave and stop using the AJIO Luxe Platform. The terms contained in this FPP Policy shall be accepted without modification and also, by using, browsing, accessing, or purchasing from the AJIO Luxe Platform, you agree to be bound by the term contained herein.
FEES AND PAYMENT OPTIONS
- Reliance does not levy any fee for browsing the AJIO Luxe Platform. Reliance may in future, consider levying fees on the User for using the AJIO Luxe Platform as a whole, or for use of certain features of the AJIO Luxe Platform. In such an event, you agree to pay any such fees, as applicable. Reliance does not covenant or guarantee providing you with a notice prior to enforcing such a levy of fees. Your continued usage of the AJIO Luxe Platform after such change in the fees will be considered to be your acceptance of such changes.
- In order to ensure User convenience, Reliance offers multiple payment options to User. Reliance without prior notice to User, reserves the right to add or delete payment options from the ones listed below:
- payment through net banking facilities;
- payment through select credit cards;
- payment through select debit cards;
- payment through online store credit in the form of ROne Points;
- payments through cash on delivery for purchases valued less than Rs. 7,500/-;
- payments through prepaid payment instruments and electronic wallets;
- Any other payment option as may be provided by Reliance from time to time. The payment options referred to above shall hereinafter collectively be referred to as “Payment Options”. While reasonable endeavours are made to offer the Payment Options through varied banking channels, presently, Reliance accepts payments only from major select banking avenues. Reliance does not accept payments made through international debit/credit cards.
- It is expressly clarified that accepting a User’s payment through the Payment Options is solely at Reliance’s discretion. Reliance reserves the right to reject payment from a User through the Payment Options for any reason whatsoever. In order to further validate a User’s transaction, Reliance may request the User to submit a copy of the User’s photo identity proof (such as the User’s PAN card), failing which, Reliance reserves the right to reject a User’s payment made through the Payment Options.
- While using the Payment Options, User agrees to provide correct, complete and accurate financial information such as credit/debit card details or prepaid payment instrument account details which may be stored by Reliance’s third party payment gateway provider. User(s) shall not use a credit/debit card or prepaid instrument which is not lawfully owned by him/her or which the User has not been lawfully authorised to use. The User shall solely be responsible for the security and confidentiality of his/her financial information. Reliance disclaims all liabilities that may arise as a consequence of any unauthorised use of the User’s financial information and/or identity, including, details relating the Payment Options.
- Reliance shall not be held responsible and shall not assume any liability in respect of any loss or damage suffered by a User owing to:
- lack of authorisation for any transaction, including such transactions carried out on gift cards and vouchers issued to User(s) as a part of Reliance’s promotions.
- exceeding of the credit/debit limit mutually agreed between the User and the issuing bank.
- any payment issue arising out of technical glitches occurring during a transaction.
- declination of transaction for reasons beyond Reliance’s control.
- Reliance reserves the right to impose limits on the number of transactions a User may undertake over the AJIO Luxe Platform. Should the User exceed such transaction limits imposed by Reliance, Reliance reserves the right to refuse to process such transactions. Reliance may refuse to process transactions emanating from User(s) who have suspicious or questionable transaction history on the AJIO Luxe Platform. Should Reliance be dissatisfied with the credibility of a User or the genuineness of a transaction carried out on the AJIO Luxe Platform, Reliance shall have the right to reject such transactions. Reliance may also choose to delay the dispatch of Products purchased by such User or cancel the entire purchase at its sole discretion. The User agrees that Reliance shall not be liable for any damage, interests or claims resulting from Reliance’s decision to not process a transaction or delay in the processing of a transaction on account of a User’s suspicious activity on the AJIO Luxe Platform.
- All the Products listed on the AJIO Luxe Platform are including all applicable taxes. You will be responsible for payment of all fees/costs/charges associated with the purchase of Products from us and you agree to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties and cesses etc. Despite Reliance’s best efforts, there may be instances of mispricing of Products on the AJIO Luxe Platform during or after the process of purchase of Products has been carried out by the User. While thorough processes of verification are carried out prior to the publication of Product prices on the AJIO Luxe Platform, errors and discrepancies arising out of technical glitches and time lags is unavoidable. For avoidance of doubt, Reliance’s curative actions that will arise in the event of a price difference arising on the actual maximum retail price of a Products against the price published on the AJIO Luxe Platform is set out below:
- If the maximum retail price of the Products delivered to the User is lower than the price published on the AJIO Luxe Platform, the User shall, within 3 (three) days from the time when he/she received the Products, intimate us at ajioluxe.pricing@ril.com in each case resulting in an acknowledgment. Upon Reliance being satisfied of the User’s claim, Reliance will cancel such order and the amount paid to the User shall be refunded as store credit in the form of ROne Points or transferred into the User’s bank account within 15 (fifteen) days from the date of receiving the written notice from the User.
- If the maximum retail price of the Products listed on the AJIO Luxe Platform is higher than what has been published and if Reliance is not providing an offer or discount on such Products, Reliance shall cancel the order and the amount paid by the User shall be refunded as in the form of ROne Points or transferred into the User’s bank account within 15 (fifteen) days by Reliance.
- In order to process such refunds, the User will be required to send an email to us at customercare@ajio.com. Thereafter, the User will receive a refund if the initial mode of payment for the order was ‘cash on delivery’ limited up to Rs. 7,500/-. If the initial mode of payment for the order was through a payment option other than the ‘cash on delivery’ option, we may transfer the refund to the User’s source account that was used to make the initial payment.
- To enable User to make payments for purchasing Products on the AJIO Luxe Platform, in addition to this FPP Policy, the terms and conditions of the User’s bank, applicable financial institution and/or card issuing association may be applicable. The User’s bank, financial institution or card issuing association may decline or prevent the User from making electronic payments for buying the Products on the AJIO Luxe Platform and Reliance does not control the same and hence, shall not be at any point in time be held liable.
- Reliance may, from time to time contract with third party payment service providers including banks, to open nodal bank accounts under applicable Indian laws. This will be done to facilitate the payments between User(s) and other third parties, apart from Reliance. These third parties may include other service providers including payment aggregators, prepaid instrument providers, courier and logistic service providers etc. Upon successful delivery of the products purchased by you through the AJIO Luxe Platform, Reliance shall initiate payments to third party service providers.
- If it is brought to the User’s notice that a charge has been created on his/her payment instrument(s) for purchase of Products on the AJIO Luxe Platform and the User is not aware of such purchase on the AJIO Luxe Platform, the User is first, required to verify if his/her family members, friends or business colleagues were authorised to carry out the purchase of Products on the AJIO Luxe Platform. If, despite this, the User continues to be unable to identify the charge created on his/her payment instrument(s) for purchase of Products on the AJIO Luxe Platform, the User may report such unauthorised purchase to us within 3 (three) days from the date on which the unauthorised purchase was carried out on the AJIO Luxe Platform in order to enable Reliance initiate investigations.
- If the User carries out a purchase on the AJIO Luxe Platform and the payment in lieu thereof has been invalidated, Reliance reserves the right to retrieve the invalidated payment (“Invalidated Payment”) from the ROne Points of the User. Should the User have insufficient store credit in the form of ROne Points in order to facilitate such redemption of the invalidated payment, the User shall within 5 (five) days from the date of receiving a written notice from Reliance, remit the Invalidated Payment into Reliance’s bank account, details of which shall be set out in the notice. If the User fails to remit the Invalidated Payment into Reliance’s bank account despite having received the notice, Reliance shall be entitled to initiate civil and/or criminal legal action against the defaulting User at his/her cost and peril.
- The ‘cash on delivery’ payment option allows Users to make a cash-only payment to our delivery executive or logistic partner at the time of delivery of the purchased Products to the User. Presently, we offer a maximum order value of INR 7,500 (seven thousand and five hundred) under the cash on delivery payment option. Reliance reserves the right not to provide cash on delivery payment option for certain Products (these could be Products specified by Reliance or Products with value exceeding a specified amount) or locations. User(s) are required to peruse and accept the terms set out under the Return Refund and Cancellation Policy which sets out the terms of refunds for transactions carried out using the cash on delivery payment option.
- Store Credit in the form of ROne Points: If a User cancels an order for which payment has already been made to Reliance, the User shall have an option to convert the amount paid towards the order into store credit. In addition, any and all refunds with respect to Products purchased through the ‘cash on delivery’ payment option will be transferred as store credit into the User’s store credit account. Reliance may also, at its sole discretion, grant User(s) with store credit. The store credits can be used by the User for future purchases only on the AJIO Luxe Platform. In the eventuality of a User wishing to deactivate his/her account with Reliance, the User agrees that all store credit available on the User’s store credit account, if any, will automatically stand forfeited, and Reliance will not be required to process any refunds in any manner whatsoever. The User therefore agrees to use and exhaust any existing store credit prior to requesting for a deactivation of his/her account on the AJIO Luxe Platform. Notwithstanding anything to the contrary, any refund of store credit to to the User will be at the sole discretion of Reliance. If Reliance suspects any fraudulent activities, Reliance reserves its right to hold back transfer of any store credits to User.

4.1 We may from time to time be required to disclose the information collected from you to our trusted third party service providers who assist us in order to facilitate the provision of services and purchase of Products on the AJIO Luxe Platform. For instance, we may share your information with third party payment gateway provider to process transactions on the AJIO Luxe Platform. By using the AJIO Luxe Platform, you consent to any such disclosure of your information with third party service providers. We ensure that such third party service providers are bound by reasonable confidentiality obligations and/ or use, maintain and follow generally accepted industry and security standards with respect to such information.
4.2 We may also disclose your information when such disclosure is requisitioned under any law or judicial decree or when we, in our sole discretion, deem it necessary in order to protect our rights or the rights of other Users, to prevent harm to persons or property, to fight fraud and credit risk.

By using the AJIO Luxe Platform, you consent to such transfer of your information outside of your country and also within our affiliates, subsidiaries and partners whose personnel and subcontractors, provided they have agreed to ensure the same level of data protection as prescribed under this Privacy Policy and the data protection laws of India. The information may be transferred in the event it is necessary for the performance of the services, operation of the AJIO Luxe Platform and provision of Products as agreed upon between us and the third party.

6.6 We may keep records of telephone calls received from and made to Users for the purpose of administration of services, research and development, training, business intelligence, business development, or for User administration. We may share such telephone records with third parties when required by law or when required to provide or facilitate the User with the services.
6.7 You consent to our reproduction/publishing of all testimonials and reviews given by you on the AJIO Luxe Platform in relation to the services or the Products. We aim to provide the best customer experience to our Users beginning from placing an order to initiating a return. While transacting on the AJIO Luxe Platform, you can expect a hassle-free experience in returning the Product that you have ordered and can rely on us as your preferred shopping destination.
This cancellation, return and refund policy (“Policy”), together with the Terms sets out our procedures and policies in accepting Product cancellation, return and refund thereof.
- APPLICABILITY OF POLICY
- By agreeing to use the AJIO Luxe Platform and/or initiating a request for purchase of Product(s) on the AJIO Luxe Platform, you agree to be bound by the terms contained in this Policy without modification. - TERMS FOR CANCELLATION, RETURN AND REFUND OF ORDERS
- Cancellation of Products
- You can cancel orders for Products partially or fully prior to issuing and processing of the invoice in relation to such Products by us. Orders cannot be cancelled once the invoice has been processed and issued.
- In case you change your mind in relation to a particular order of the Products, you may cancel the placed purchase order, by referencing the unique tracking identity number (which enables the User in tracking the status of delivery of the purchased Products) received by you from us and requesting us to process a cancellation by cancelling the Product on Platform.
- On receipt of the cancellation request prior to issuing and processing of the invoice we shall cancel the order and initiate the refund for the Products within 7-10 (seven to ten) business days from the receipt of the cancellation request from you. The amount shall be refunded to you through the same mode of payment used by you for the purchase or via credit to your store credit account in the form of ROne Points which can be used for subsequent purchases. All refunds, except for refund to store credit account in the form of ROne Points, shall be subject to applicable policies and charges of the User’s bank/ financial institution.
- Return of Products
- You may initiate the request for return of the Product if: (i) Product is damaged; (b) both the Product and shipping package have been damaged; (iii) Product is defective or is not in working condition; (iv) the Product is of bad quality; (v) parts of the Product or accessory is missing; (vi) the Product ordered is different from what was ordered basis the Product description provided on the AJIO Luxe Platform; or (vii) you are dissatisfied with the purchased Product (“Non-Compliant Product”). You shall initiate such requests for a return of ‘ready to ship’ Products within 30 (thirty) days from the date on which you receive the delivery of the Product (“Return Period”).
- You shall keep the Products in its unused, original condition, along with the original invoice/ sale receipt, brand outer box, MRP tags attached, user manual, warranty cards, and original accessories in manufacturer packaging for a successful return pick-up. We would accept the request for return of such Product subject to the terms of this Policy.
(c) If you have received any Product which is subject to return in terms of this Policy, we suggest you to immediately register a request in this regard on the AJIO Luxe Platform. We will in our sole discretion verify if: (a) the defects and damages in the Products or the non-compliances claimed in such Products are acceptable by us, or (b) such defects, damages or non-compliances are due to our default, and will accordingly post verification, accept or reject the request for return. For such verification, we may request you to send us images of the damaged, defective or Non-Compliant Product received and/or allow our personnel to schedule a visit to assess the damage, defect or non-compliance in the Product. Further to the assessment of the damage or the concern reported in the return request, we may in our sole discretion resolve the issue subject to the assessment report, in a manner as we may deem fit.
- Your return will be processed only when the conditions as may be stipulated by us are fulfilled at the time of return of such Products, such as the Product being returned in original condition (including water seal stickers in case of fragrances), along with the price tag intact including original packaging of the product, the brand outer packaging of the Non-Compliant Product and all accessories therein, no damage having occurred post-delivery of the Product while in your possession etc.
- You agree that we will not accept the return of any Product: (i) if you have placed the order for a wrong product model, colour or incorrect Product, (ii) if the Product belongs to non-returnable Product category (For instance, personalised Products that are not suitable for return based on their nature), (iii) if you fail to request return/register a complaint in relation to a Non-Compliant Product within the Return Period (iv) ‘Made to Order’ Products. Any damage to the Product caused by your improper wearing or safekeeping of the Product, or any modification or change to the Product by you the User or a third party or any depreciation in the value for other reasons will not be deem such Product a Non-Compliant Product and will not be considered a quality problem. Any decision by us in this regard shall be final and binding.
(f) You can return the Product(s), purchased from us provided the Product(s) satisfy below mandatory conditions:
(i) The Product has not been worn, cleaned or tampered with by you.
(ii) The price tag /bar code, brand tags, original packaging material, accompanying accessories is intact and not altered, damaged or discarded by you.
(iii) The Product is not altered, unless proven vendor defect.
(iv) Return is being initiated against the order under which it was bought and from same account and the serial number/ bar code of the Product matches our records.
(v) There is no foul odour, perfume, stains, dents, scratches, tears or damage on the Product.
(vi) The Product(s) if bought as a set should be exchanged as the complete set.
(vii) Products returned should be in unused, undamaged, unwashed and in a saleable condition.
(viii) We are satisfied that the Product has not been rendered defective or unusable.
We reserve the right to reject the return request for a Product if it does not satisfy the aforementioned conditions.
(g) Return of purchased Products are facilitated through our reverse-logistics partners. On receipt of request for return of Product on the AJIO Luxe Platform and the same being duly acknowledged by us, our reverse-logistics partners may get in touch with you in order to collect the purchased Products from you.
(h) You may also return a Product purchased by you on the AJIO Luxe Platform at our physical stores/ boutiques provided you give the following information: (i) details of the Product; (ii) original invoice of the Product; (iii) order number; (iv) reasons for return; and (v) your contact information.
2.3 Refund
- At the time of raising a request for return or cancelling the Products on the AJIO Luxe Platform, you may seek refund for the Non-Compliant Product. Such refund will be made to the you only in the even the payment has been received by us for the Product.
- Please be informed that when you opt to cancel or return the Products, upon our verification and assessment of the Products and the documents relating thereto, the refund amount for such Products which are eligible for return as per the terms of this Policy, will be processed within a period of 7-10 (seven to ten) business days from the date of us verifying the defect or the non-compliance in the Product. Your refund will be processed only when the conditions as may be stipulated by us are fulfilled, such as the Product being returned in original condition, along with the price tag intact including original packaging of the product, the brand outer packaging of the Non-Compliant Product and all accessories therein. For the sake of abundant clarity, it is clarified that we shall not make any refund in respect of a Product that is deemed ineligible for a refund based on our verification and assessment. The refund amount will be credited to the original payment mode opted by you or the Wallet (defined below), as may be chosen by you. You acknowledge that after initiation of refund, it may take additional time for your refund to reflect in your account which is subject to your financial institution or payment solution provider terms and conditions.
- We do not make any cash refunds. The amount will be refunded to you within 7-10 (seven to ten) working days depending upon the mode of payment chosen by you. Sometimes banks or financial intermediaries take a longer time to process the refund request. However, if the refund does not happen by the date advised, you may contact us, and we will gladly help you. Alternatively at your option, the said amount can be credited to your Wallet which can be used for your subsequent purchases on the AJIO Luxe
- Refund to be made to the User shall not include any amount paid towards shipping charges or any other such charges applicable from time to time. However, in the event a Product has been delivered with a defect or damage (for reasons attributable to, and accepted by us after due verification at its sole discretion) we may refund the shipping charges to you. You will be provided with a refund if you have received a non-returnable Product in a damaged or defective condition subject to verification and examination of the damage or defect of the Product by us.
- We reserve the right to reject a refund request for a Product if it does not satisfy the quality conditions specified under this Policy on our assessment pursuant to its return. We may in such cases notify you and send the returned Product back without initiating a refund.
2.4 Exchange of Products:

1.2 This delivery and shipping policy (“Policy”), together with the Terms sets out our policies and procedures towards delivery and shipping of Products purchased on the AJIO Luxe Platform.
1.3 We provide shipping and delivery of our Products all over India. We aim to provide the best customer experience for you by tying-up and partnering with leading logistics service providers to handle your order in the best possible way and to ensure that you have a hassle-free experience in receiving the Product that you have ordered from the AJIO Luxe Platform . We make all commercially reasonable endeavours to ensure that the Products are delivered to you in a timely fashion.
1.4 By agreeing to use the AJIO Luxe Platform and/ or purchasing a Product on the AJIO Luxe Platform, you agree to be bound by the terms of this Policy without modification. We encourage you to read and understand the terms of this Policy every time you visit the AJIO Luxe Platform. If you do not agree to the terms contained in this Policy, you are advised not to use, access or transact on the AJIO Luxe Platform.
- TERMS OF SHIPPING AND DELIVERY
2.1 We partner with third party logistic service providers in order to effectuate Product shipping and delivery to you ("Logistic Partners"). We shall provide the details of the Logistic Partner which will be responsible for processing the shipping and delivery of any Product(s) purchased by you on the AJIO Luxe Platform at the time such Product is processed and successfully handed over to the Logistic Partner by us. For ready-to-ship brands, the standard timeline is 48 hours from the receipt of order. For Made-to-Order brands, the timeline can vary anywhere between 5 to 14 (five to fourteen) days and for few home furnishing brands timeline range between 8-10 (eight to ten) weeks from the date of order of the Product by you on the AJIO Luxe Platform. In any case the user will be provided with an estimated timeline for the delivery of the Product purchased from the AJIO Luxe Platform. This estimated timeline shall be notified to the user on the order confirmation page displayed at the time the order is confirmed by us. We will also share details about your orders pursuant to their dispatch on the e-mail ID and/or mobile number provided by you/ registered with us. You agree and understand that though we effectuate Product delivery to the Users through our Logistic Partners, we reserve the right to ship and deliver the Products on our own without engaging any Logistic Partners or third party service providers.
2.2. You agree and understand that though we endeavour to ship and deliver our Products all across India, we may, in our sole discretion determine a select list of areas which are unserviceable for delivery of Products. We or our Logistic Partners do not provide shipping and delivery services in such unserviceable areas and may not process your orders on the AJIO Luxe Platform in such cases. In the event an area has been deemed unserviceable by us, we shall notify such user at the time of placing an order for purchase of Products on the AJIO Luxe Platform. You may also verify whether an area is unserviceable for deliveries by us by entering the relevant area pin-code on the AJIO Luxe Platform.
2.3. You agree and acknowledge that to effectuate timely delivery of the purchased Products to you we may inquire or collect specific information like your name, shipping address, billing address, landmarks, contact details, etc. You shall ensure that all information that is submitted by you to us on the AJIO Luxe Platform is true, complete, accurate and sufficient to identify the actual place of delivery. You understand that you shall bear absolute liability in case of any failure by us in delivering the purchased Products due to your failure to provide correct, complete, sufficient and accurate information at the time of placing the order. It is further clarified that we shall not be liable in any manner and at any point in time due to your failure to provide correct and complete information.
2.4. We will attempt to deliver the purchased Product to your designated address within the estimated timeline of delivery notified to you. In the event you are not available or present to accept the delivery of the Product, our Logistic Partners will make a maximum of 3 (three) attempts to deliver the purchased Product(s) to you. If the third delivery attempt is unsuccessful and you continue to remain unavailable, we reserve the right to cancel the order of the purchased Products at our sole discretion and process the return of such Product to us. We further reserve the right to deduct the shipping and delivery charges borne by us while processing any refunds subsequent to such cancellation.
2.5 While we make reasonable endeavours in ensuring that purchased Products are delivered to you in a timely manner and within the timeline notified to you, you accept and acknowledge that the delivery may be delayed on account of:
(a) Logistical issues beyond our control;
(b) Unsuitable weather conditions;
(c) Political disruptions, strikes, employee-lockouts, etc.;
(d) Acts of God such as floods, earthquakes, etc.;
(e) Other unforeseeable circumstances.
In such events of delay, we shall make reasonable attempt to inform you by writing to your email ID and/or mobile number registered with us. We disclaim all liabilities that may arise on account of our failure to inform or notify you of delays in the delivery of purchased Products on the AJIO Luxe Platform. Further, we shall be under no obligation to compensate you for any claim that may otherwise arise on account of delay in the shipment or delivery or use of the purchased Products.
2.6. We endeavour to engage Logistic Partners, employees, agents with the highest regard for ethics and integrity; and behave in a fashion that exudes thorough professionalism, competence and good mannerism. You agree and acknowledge that the actions, inactions of delivery individuals are not in our control, and it is not possible for us to monitor and observe each delivery executive. Since we are merely facilitating delivery of a Product purchased by you, we shall not be liable for any acts or omissions on part of our delivery agents, employees, or personnel and/ or the Logistic Partner or their employees, agents, or personnel including deficiency in service, wrong delivery of Product, time taken to deliver the Product, Product package tampering, etc. For the sake of abundant clarity, it is stated that any ill-mannerism, impoliteness, discourtesy or offensiveness shown by our delivery executives or the employees, agents, personnel of the Logistic Partners is beyond our control and any issue arising between you and our delivery executive or an employee, agent, personnel of the Logistic Partner will have to be resolved by the you, independently. You agree and acknowledge that you will not hold us responsible or require us to settle, mediate or resolve any disputes between you and the delivery personnel delivering the Products to you.
2.7. Once you place an order on the AJIO Luxe Platform, we process such order and hand over the purchased Product to our Logistic Partner. The User will receive a unique tracking identity number once the purchased Product is handed over to the Logistics Partner, which will enable the User in tracking the status of delivery of the purchased Products. The User may use the tracking identity number on the AJIO Luxe Platform or the website and/or the mobile application of the Logistic Partner to check the status and location of the purchased Product and its estimated time of delivery. Our customer service team coordinates with the Logistic Partners to ensure that the Products are delivered to you at the earliest and make all reasonable efforts in ensuring that the Logistic Partners update the tracking status of the purchased Products on a real time basis. It is clarified that we engage third party service providers to effectuate deliveries of the Products and hence, we do not guarantee the accuracy or correctness of the tracking status and the status may be subject to inconsistencies arising out of time-lags in updating the information and/ or other technical difficulties which are not in our control.
2.8. We reserve the right to charge or collect shipping fees on Products from time to time. Shipping charges may vary based on the value of the Product, type of Product, area of delivery, payment mechanism, etc. You agree that we are authorized to collect, on behalf of the Logistic Partner, the shipping and delivery fees for the delivery service provided by the Logistic Partner. In the event we charge a shipping fees for the delivery of a purchased Product, such shipping fees will not be refunded by us pursuant to any return request raised by you. However, we may make exceptions and refund the shipping fees in the event a defected, damaged, deficient or incorrect Product (for reasons attributable to, and accepted by us after due verification in our sole discretion) has been delivered. You acknowledge and accept that the title and risk of all Products ordered by you shall pass on to you upon the delivery of the purchased Products to you.
2.9. Return of purchased Products are facilitated through our reverse-Logistics Partners. On receipt of request for return of Product on the AJIO Luxe Platform and the same being duly acknowledged by us, our reverse-Logistics Partners shall get in touch with you in order to collect the purchased Products from you. We process returns and exchanges of purchased Products in accordance with our Cancellation, Return and Refund Policy.
